Thank you for using our products and services (the “Service/s”). By becoming a member or using our Services, you accept and agree to these Terms and Conditions (“Terms”). Therefore, it is important that you carefully read through these Terms. If you do not agree to these Terms, you should not register with Retroid Labs S.L.

These Terms govern the use of Omnio, and, any other related Agreement or legal relationship with the Owner in a legally binding way. Capitalized words are defined in the relevant dedicated section of this document.

1. Health and nutritional information

The following documents are incorporated by reference into these Terms:

Medical Services Disclaimer. Omnio encourages you to consult with your healthcare provider before using the Service. You represent that you are in good enough health to begin using the Service, which may include changes to your diet or level of physical activity, among other things. If you have been diagnosed with a health condition that may be impacted by the Service, you represent that you have obtained the express approval from a health care professional to use the Service. The Service requires your active engagement and participation. You understand that, despite your efforts, individual users’ results will vary for a variety of reasons and Omnio cannot guarantee that you will achieve your health goals.

The service does not include the provision of medical care by Omnio or any third party. Omnio is not a licensed medical care provider, and our specialists are not acting in a health care professional capacity. Our specialists do not provide any medical or clinical services, and do not diagnose, treat or manage any illness, disease or condition. Omnio and our specialists do not have expertise in diagnosing, examining, or treating medical or psychological conditions of any kind, or in determining the effect of any specific exercise on a medical condition. You should not change your treatment or care plan, medication or therapy based on information you received through the service or from one of our specialists. Consultation with our specialists is supplemental to any treatment or care provided by your health care provider and should not replace regular medical visits with your health care provider. Always seek the advice of your physician or other qualified health care practitioner regarding your medical condition or the use (or frequency) of any medication or medical device. Information provided by our specialists is offered for informational purposes only and is not a recommendation or endorsement of any drug, device or treatment or representation that a particular drug, device or treatment is safe, appropriate, or effective for you. Questions regarding any drug, device or treatment should be directed to you healthcare provider. Never disregard professional medical advice or delay in seeking it because of something you have read in connection with the service. Always consult with your healthcare professional if you have any questions or concerns about your health or condition or experience any changes in your condition or health status. The service does not include emergency, time sensitive or urgent, remote or critical care services. If you think you have a medical emergency, call 911 or go to the nearest open emergency room immediately.

2. Using our Services

All of the personal data provided by you is accurate and up to date.
You are solely responsible for all activities on your account and all the content that is uploaded and/or created under your Retroid Labs S.L. account (“User Material”). Retroid Labs S.L. does not monitor the contents of the Service, but may at any time choose, at its sole discretion, to remove User Material from the Service and/or your user account and to terminate your account and membership.
Your membership, including your email and password, with Retroid Labs S.L. is personal and may not be transferred or used by someone else. You are responsible for storing your login details in a safe manner. Retroid Labs S.L. is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login details. If you learn of or suspect any unauthorized use of your account, you must immediately inform Retroid Labs S.L. Customer Service. Contact details are available at the bottom of this document.
Violation of any of these Terms will lead to a direct termination of your user account and subscription. If you violate these terms, you will not get a refund.
You may not engage in any commercial activities, advertise and/or provide hints (such as links) on where commercial activities are present through our Services.
You may not contribute with any propaganda, religious and/or political views, or contribute with information which in any way contains or involves incitement to racial hatred, child pornography or pornography through the use of our Services. Further, you may not defame, harass or offend other people through the use of our Services.
If you have any criticism or feedback regarding Retroid Labs S.L. or our Services, you will first contact Retroid Labs S.L. to help us to improve our Services.
You may not transmit, and/or distribute files that may damage Retroid Labs S.L. or others’ computers or property (such as viruses and trojan horses).
You may not share others’ personal information, without their approval.

3. Intellectual Property

All rights in and to the Services, including any trademarks, service marks, trade names and copyrighted content (collectively “Intellectual Property”) presented within the Service are the property of Retroid Labs S.L. and/or third parties.

You agree not to use Intellectual Property for any other purposes except for your use of the Service, unless required otherwise by applicable mandatory law.

By submitting User Material to Retroid Labs S.L., you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your content. You agree to grant Retroid Labs S.L. a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for Retroid Labs S.L. to operate and maintain the Service. This license shall remain valid until the respective User Material is deleted from the Service by you or by Retroid Labs S.L. in accordance with these Terms.

4. Disclaimer and limitation of liability

You use the Service at your own risk. The Service is provided “AS IS”, without any warranties, and Retroid Labs S.L. does not warrant that the Service and availability thereof will be uninterrupted or error free. Retroid Labs S.L. does not assume any responsibility for errors or omissions in the information or software or other documents, including User Material, which are referenced by or linked to. References or links to third parties' websites are provided "AS IS" without warranty of any kind, either express or implied.

5. Miscellaneous

For the sake of clarity, Retroid Labs S.L. doesn’t undertake the obligation to monitor the contents of User Material. We allow users to see content generated by other users. Sometimes, users may view content that we deem as inappropriate.

You are not entitled to assign your rights and/or obligations under these Terms or use of the Service to any third party without Retroid Labs S.L. prior written consent. Retroid Labs S.L. is entitled to assign its rights and/or obligations under these Terms.

Retroid Labs S.L. reserves the right to refuse the Service to anyone for any reason at any time. Retroid Labs S.L. may revise these Terms from time to time and the most current version will always be posted on Retroid Labs S.L. website (https://global.omnio.site/). Any and all material changes shall become into effect between you and Retroid Labs S.L. upon your acceptance of such changes (e.g. by using the Services after such notification has been made to you or renewing your subscription).
